Booking & Scheduling

Please fill out this form. It consists of 3 sections. These sections cover details about the booking, session, pricing, and necessary information for both parties.

This agreement is made between the Photographer :The Gill Photography and the Client, as detailed below:

Summary of Services
The Photographer agrees to offer photographic coverage as outlined in this agreement. The Client agrees to engage the Photographer for the selected session type and duration. The Client also agrees to pay the fees as detailed in the Payment & Booking section.
The Photographer will give coverage on the agreed date and time. All terms and conditions in this contract apply to the session.

PAYMENT ARRANGEMENT: 

1. Payment & Booking

  • A non-refundable retainer is due at booking.
  • The remaining balance must be paid before the session date.
  • Texas sales tax (8.25%) applies to all retainers and packages.
  • Booking is confirmed only after the form is submitted and booking payment is received.

2. Travel & Lodging

  • Sessions beyond 25 miles from Little Elm, TX incur a $3.00 per mile round-trip travel fee.
  • If overnight lodging is required, a $100 lodging fee applies.

3. Photo Gallery & Digital Images

  • After receiving the edited gallery, clients will have the choice to buy extra images.
  • Extra images at $20 per image
  • The full gallery at $15 per image (excluding pre-agreed edits)

4. Cancellation & Rescheduling

  • Retainers are non-refundable, but transferable if rescheduled.
  • Please give 48 hours’ notice for cancellations or changes.
  • Weather-related delays will be rescheduled at no extra cost.
  • If the session is canceled due to uncontrollable events (e.g., illness, fire), retainers stay due.

5. Cooperation & No-Shows

  • The photographer is not responsible for missed shots due to lack of cooperation or no-shows.
  • Only the photographer’s camera is permitted during the session.
  • No-shows will reschedule with an extra 25% retainer fee.

6. Reshoot

  • If dissatisfied with results, one free reshoot is offered.
  • If still unsatisfied, a full refund will be issued, and no images will be retained. Only for a valid reason. ( example eyes closed, blurry or distorted images)
  • Photographer retains rights to all session images.

7. Image Storage

  • Ordered images are stored for 3 months.
  • Unordered images are deleted after 30 days.
  • Clients are responsible for backing up their images.
  • Photographer is not liable for USB/DVD failures or data loss.

8. Retouching

  • Basic retouching includes blemish and stray hair removal.
  • Advanced retouching (e.g., scar removal) is billed at $30/hour per image.
  • Photographer can decline edit requests and finalizes images based on professional standards.

9. Copyright & Usage

  • All images and copyrights belong to The Gill Photography by Waqar Gill.
  • Photographer can use images for marketing, competitions, education, and more.
  • RAW/unedited files will not be shared or sold.
  • Clients can use images for personal use only (e.g., printing, emailing, posting).
  • Commercial use is prohibited without written permission.
  • The photographer can revoke usage rights at any time.

10. Social Media Use

  • When posting images online:
  • Do not alter the images (no filters, text, or cropping).
  • Credit must be given to Waqar Gill / The Gill Photography.
  • To opt out of social media sharing, Please mention in the notes:

11. Model Release

  • Client grants permission for use of their images (or their children’s) for promotional purposes.
  • Photographer edit and copyright these images.
  • For boudoir sessions, no nude or facial images will be used without written consent.

12. Exhibition Use

  • Photographer can show selected images for portfolio or competitions.
  • Client waives any claim to profits from such use.

13. Limit of Liability

  • Photographer takes great care with all images.
  • If originals are lost or damaged:
  • A refund or free reshoot will be offered.
  • Partial loss will be refunded proportionally.
  • If Photographer is ill or injured:
  • Will try to reschedule or find a replacement.
  • If no replacement is found, payments will be refunded.
  • In case of full cancellation or failure, liability is limited to the contract value.

14. Changes to Agreement

  • Changes result in extra charges.
  • Clients extend session time (if photographer is available), but can’t shorten it.
  • If the session is cut short due to uncontrollable events, retainers stay due.

15. Independent Contractor

  • Photographer is an independent contractor, not an employee.

16. Entire Agreement

  • This agreement replaces all prior agreements.
  • Changes must be made in writing and signed by both parties.
  • Waiving one provision does not waive others.
